You and Us

The use of this website means that you are agreeing to accept the terms and conditions of use.

“We” and “us” means HeritageCharm

“You” means the person using the website

 The “website” means on www.heritagecharm.com

These terms and conditions apply to the website on www.heritagecharm.com, its contents and products.

By using the website you confirm that you are at least 18 years old, or, if you are under 18, that you are accessing the website with the consent of your parent or guardian.  You also warrant that you are legally capable of entering into binding contracts.

Under no circumstances shall HeritageCharm be liable for any indirect, special, incidental or consequential damages of any kind, regardless of the form of action, whether in contract, tort (including negligence), strict product liability or otherwise, even if we have advised of the possibility of such damages.

All of the designs displayed on www.heritagecharm.com are the intellectual property.

You may not copy, reproduce, distribute, republish, download, display, post or transmit any of the websites without written consent from us.

The images on the site are for information purposes only.

You shall not use the website in any way that will damage it or interrupt its provision.  You shall not use the website to transmit or post any computer viruses.  We cannot guarantee that the website is free from computer viruses, and you should take your own precautions in this respect.

We will try to make sure that the website is always available.  However, this is not always possible, and we are not liable if the website is unavailable.

Accuracy of Content

The website may contain links to other websites; these external websites are not under our control.  We cannot be held responsible for such websites and cannot make any guarantees about them.  We provide these links because we think they might interest you, but we do not monitor or endorse these other websites.

We reserve the right to terminate the website or remove any of the services on it with immediate effect at any time.

Very occasionally information displayed on our site may be incorrect due to system errors.  We will of course make every effort to avoid errors but if they do occur we will not honour inaccurate or erroneous prices.  Our prices may be subject to change without notice.  Orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website.

Goods are charged at price shown on the product pages on the date the customer places the order. Prices are correct at time of publication. Errors and omissions are accepted. Orders will be processed at our published prices; otherwise, in the case of any unexpected change in price, you will be informed and asked if you wish to reconsider your order before proceeding. All prices are stated in British Pounds Sterling (£ GBP).

Every attempt has been made to ensure that the jewellery displayed on www.heritagecharm.com is as accurate as possible.  However, some products may appear large or smaller than their real size and since every computer monitor is different, variations in colour may occur.

The jewellery displayed on heritagecharm.com is all handmade and consequently variations in the exact appearance of the jewellery will inevitably occur.

The product images, descriptions, specifications weights and dimensions are intended to give an approximate indication of the size of individual products.

Making an order

All orders are subject to acceptance and availability. If the items you have ordered are not available from stock, we will contact you by e-mail or phone (if you have given us details). You will have the option to wait until the item is available from stock or to cancel your order.

Payment terms

All payments must be received and authorised before shipment.

Delivery

Delivery is via Royal Mail Special Delivery to UK only.  (99% UK coverage)

Our delivery charges are set out on the checkout page on our website.

It might not be possible for us to deliver to some locations.

We will deliver the jewellery to the address you specify for delivery in your order. It is important that this address is accurate. Shipments dispatched remain our responsibility until received by the recipient.  HeritageCharm is not responsible for jewellery where delivery has been attempted, but no signature was obtained by the delivery company.  We cannot accept any liability for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions (unless this is caused by our negligence). We will aim to deliver the goods by the date quoted for delivery but delivery times are not guaranteed. If delivery is delayed due to any cause beyond our reasonable control, the delivery date will be extended by a reasonable period and we will contact you to arrange an alternative time.

Jewellery is not guaranteed for delivery on Saturday and HeritageCharm is not responsible for any loss or claim resulting from this fact.

Risk and ownership

You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.

Risk of damage to or loss of the goods passes to you at the time of delivery to you, or if you fail to take delivery at the agreed time, the time when we tried to deliver. You will only own the goods once they have been successfully delivered and when we have received cleared payment in full. Goods supplied are not for resale.

Return / Refund Policy

The ‘Consumer Contracts Regulations 2014’ give you the right to change your mind and cancel an order within seven working days. If you do decide to cancel, you should put this in writing, either by letter (a proof of postage certificate or recorded delivery is recommended) or you can email. A telephone call is not sufficient. It is important that you have proof that a cancellation notice was both sent and received by the trader.

You must take care of goods whilst they are in your possession and, if you are returning them, you should take reasonable care to ensure that we receive them and that they are not damaged in transit. The goods must be adequately packaged in their original packaging, correctly addressed and carry the correct postage. You will have to pay the return postage yourself, unless the goods were faulty in the first place.

If you decide to return the goods within these time limits, you are entitled to expect your money to be refunded within 30 days.

Customers that return items to be exchanged will be charged return postage.

The refund policy applies to ready to wear jewellery, Heritagecharm.com.

The refund policy does not affect your statutory rights.

Faulty or Damaged items

If you should receive a faulty or damaged item, please notify us within seven days.

To arrange a return, or if the item you received is faulty or is not what you originally ordered, please email myheritagecharm@gmail.com quoting your name and address, details of the product, the reason for return and whether you require a replacement. We will then advise on how to proceed with the return.

You will be re-credited for the costs incurred in returning faulty goods.

Jewellery returned remains the responsibility of the customer until received back by Heritagecharm.com together with the appropriate paperwork and packaging.

Cancellation by us

We reserve the right to cancel the contract between us if we have insufficient stock to deliver the goods you have ordered; we do not deliver to your area; or one or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.

If we do cancel your contract we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible, but in any event within 30 days of your order.

Privacy

We reserve the right to change these Terms & Conditions of use from time to time.  If this happens, we will notify you by posting the new Terms & Conditions of use on the website.  If you do not wish to be governed by the revised Terms & Conditions of use, please stop using the website.
